1.Agreement to these Terms
These Terms of Service ("Terms") form a binding agreement between you and Alist Archive LLC, a Delaware limited liability company ("ALIST", "we", "us", or "our"). They govern your access to and use of www.alistarchive.com, any ALIST subdomain, application, or successor site (together, the "Services"), and any purchase, sale, or consignment made through the Services.
By accessing the Services, creating an account, or placing an order, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.
The following documents are incorporated into these Terms by reference and apply to you as if set out in full here: the Privacy Policy, Cookie Policy, Returns & Refunds Policy, Shipping & Delivery Policy, Payments, Taxes & Billing Policy, Authenticity Guarantee & Condition Standards, and (if you consign with us) the Seller & Consignment Terms.

Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, for material changes, provide additional notice (for example, by email to the address on your account or by a notice on the Services) at least 15 days before the change takes effect, except where an immediate change is required by law or for security. Changes do not apply retroactively to orders already placed, and they do not apply to a dispute of which we had notice before the change. Your continued use of the Services after the effective date of a change means you accept the updated Terms.
2.Who may use the Services
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate registration and billing information and keep it current.
- You may not use the Services if you are barred from doing so under U.S. law, are located in a jurisdiction subject to comprehensive U.S. sanctions, or appear on any U.S. government restricted-party list.
- You may not use the Services on behalf of another person without that person's authorization, and you are responsible for activity under your account.
- We may refuse, limit, suspend, or terminate access to the Services, or cancel an order, at our discretion where we reasonably believe it is necessary to prevent fraud, abuse, or a violation of these Terms or applicable law.
The Services are directed to users in the United States. We make no representation that the Services or any item is appropriate or available for use in other locations, and we do not knowingly collect personal information from anyone under 18.
3.What ALIST is
ALIST is a curated marketplace for pre-owned and vintage luxury goods. Items are sourced from individual consignors and professional supply partners, reviewed by our authentication team, and listed by ALIST.
Unless a listing expressly identifies a different seller, ALIST is the seller of record for that item and is the party responsible for order fulfillment, returns, and applicable sales tax collection. Where an item is offered by a third-party seller through the Services, the listing will identify that seller and any additional terms that apply.
ALIST is not affiliated with, authorized by, sponsored by, or endorsed by any brand, designer, or trademark owner whose goods appear on the Services. Brand names, model names, and images are used solely to identify and describe the item offered for resale.
4.Accounts and account security
Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at camilla@alistarchive.com if you believe your account has been accessed without authorization.
We may require identity verification before accepting an order, releasing a payout, or reinstating an account. We may decline to create or may close an account that we reasonably believe is duplicative, fraudulent, or used to circumvent a prior suspension.
5.Listings, condition, pricing, and availability
- Inventory is generally one of a kind. An item shown as available may sell before your order is accepted; if that happens, we will cancel the affected line and refund any amount charged.
- Photographs are of the actual item unless labeled otherwise. Color, texture, and scale may appear differently across screens.
- Measurements are taken by hand and are approximate. Sizing reflects the label, which may differ from a current-season equivalent from the same brand.
- Descriptions note the condition characteristics identified by our team. Minor signs of wear that are consistent with the stated condition grade may not all be individually listed.
- We correct pricing, description, and availability errors at any time. If an item was listed at an incorrect price, we may cancel the order before shipment and refund you in full; we will not charge the corrected price without your consent.
No investment advice
Editorial content on the Services may discuss collectibility, rarity, or resale value. That content is provided for information only. ALIST does not provide investment, tax, or appraisal advice, does not guarantee that any item will retain or increase in value, and does not offer any item as a security or investment product.
6.Orders, acceptance, and cancellation
Your order is an offer to buy. A confirmation email acknowledges receipt of your order; it is not acceptance. We accept your offer when we ship the item. Until then, we may decline or cancel all or part of an order, including where the item is unavailable, where we identify a pricing or description error, where we cannot verify your identity or payment method, where an order appears to be for resale or is otherwise outside normal consumer purchasing patterns, or where fulfillment would violate law or these Terms.
You may request cancellation before shipment by contacting camilla@alistarchive.com. Because items are picked and packed quickly, we cannot guarantee that a cancellation request will be processed in time. Once shipped, the Returns & Refunds Policy applies.
Purchase limits may apply. Items are sold for personal use, not for commercial resale, and we may cancel orders that appear inconsistent with personal use.
7.Authenticity Guarantee
Every item is reviewed by our authentication team before it is listed. Our Authenticity Guarantee, including how to submit a claim and what documentation is required, is set out in the Authenticity Guarantee & Condition Standards. A claim must be submitted within 30 days of delivery.
Where we determine that an item is not authentic, your remedy is a full refund of the purchase price, applicable taxes, and shipping paid, and return shipping at our cost, upon return of the item in the condition in which it was delivered. That refund is your sole and exclusive remedy for a claim that an item is not authentic.
8.Digital certificates of authenticity
Some items are accompanied by an ALIST digital certificate that records the item's identifiers, authentication record, and supporting media, with a reference published to a public blockchain.
- A digital certificate is a record of our authentication work. It is not a security, an investment contract, a currency, an appraisal, or a guarantee of resale value.
- A certificate does not create rights in any third-party trademark and does not represent any endorsement by the brand that made the item.
- Information published to a public blockchain is, by design, permanent and publicly visible. We publish only item and certificate identifiers and never publish your personal information on-chain. Because on-chain records cannot be altered or deleted, requests to delete personal information cannot extend to data already written to a public blockchain by design (see the Privacy Policy).
- We may discontinue, migrate, or change the technical implementation of certificates. The authentication record itself remains available to you through your account or on request.
9.Prices, payment, and taxes
Prices are in U.S. dollars and exclude shipping and applicable taxes, which are shown before you submit your order. Accepted payment methods, authorization holds, sales tax collection, and third-party financing options are described in Payments, Taxes & Billing.
By submitting an order you authorize us and our payment processors to charge your selected payment method for the total shown, and you represent that you are authorized to use that payment method.
10.Shipping, title, and risk of loss
Shipping methods, timeframes, signature requirements, and international restrictions are described in the Shipping & Delivery Policy.
Title and risk of loss pass to you upon delivery of the item to the address you provided. If a package is confirmed delivered but you did not receive it, report it to us within 48 hours of the carrier's delivery scan so that we can open a carrier investigation.

12.Restricted materials and prohibited items
ALIST applies a materials policy that is stricter than U.S. law requires. We do not knowingly accept, list, or sell:
- items containing real animal fur, ivory of any species, tortoiseshell, or any material from a species listed in Appendix I of the Convention on International Trade in Endangered Species (CITES);
- items containing exotic skins where we cannot verify lawful provenance and any required CITES or state documentation;
- counterfeit, replica, or unauthorized goods, or goods bearing altered or removed brand identifiers;
- items that cannot lawfully be resold in the destination jurisdiction, including under state bans on fur or ivory sales; and
- weapons, hazardous materials, and any item whose sale or shipment is restricted by law.
If an item is delivered to a jurisdiction that prohibits its sale or possession, we will cancel the order and refund you in full. Reporting a suspected policy violation to camilla@alistarchive.com helps us enforce this section.
13.Selling and consigning with ALIST
If you submit an item to us for consignment or direct purchase, the Seller & Consignment Terms apply in addition to these Terms, including warranties of title and authenticity, commission and payout terms, and our right to decline or return an item.
14.Your content and feedback
"User Content" means anything you submit through the Services, including photographs, item descriptions, reviews, and messages. You keep ownership of your User Content.
By submitting User Content you grant ALIST a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify for formatting, publish, and display that content in connection with operating, marketing, and improving the Services. For photographs of a consigned item, this license survives the sale of the item so that the item's record and provenance remain available.
You represent that you own or have the necessary rights to your User Content, that it is accurate, and that it does not infringe any third-party right or violate any law. We may remove User Content at any time.
If you send us suggestions or feedback, you grant us an unrestricted, perpetual right to use them without obligation or compensation to you.
15.Acceptable use
You agree not to:
- use the Services for any unlawful, deceptive, or infringing purpose, including offering counterfeit goods;
- scrape, crawl, harvest, or use automated means to access, copy, or monitor the Services or any catalog data, or to reproduce our listings, photographs, or descriptions on another platform;
- circumvent rate limits, access controls, authentication, or security measures, or probe or test their vulnerability;
- interfere with the operation of the Services, introduce malware, or place unreasonable load on our infrastructure;
- misrepresent your identity, impersonate another person, or use another person's payment method without authorization;
- purchase items for the purpose of resale in a manner that circumvents purchase limits, or coordinate bidding, pricing, or purchasing to manipulate availability or price;
- harass, threaten, or abuse our staff, consignors, or other users; or
- use the Services to develop a competing product or to train a machine-learning model on our content without our prior written consent.
16.Intellectual property
The Services and their content — including text, photographs, graphics, layout, software, and the ALIST name and logos — are owned by Alist Archive LLC or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. No other rights are granted.
Third-party trademarks, including brand and model names, remain the property of their respective owners and are used descriptively to identify pre-owned goods offered for resale.
17.Copyright and trademark complaints
We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512) and to good-faith notices of trademark infringement. To submit a notice, provide our designated agent with:
- your physical or electronic signature;
- identification of the copyrighted work or trademark you claim has been infringed;
- identification of the material you claim is infringing and its location on the Services (a URL is best);
- your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the use is not authorized by the rights owner, its agent, or the law; and
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or are authorized to act on the owner's behalf.
If material you posted was removed, you may submit a counter-notice containing the elements required by 17 U.S.C. § 512(g). Notices and counter-notices are forwarded to the other party. Knowingly making a material misrepresentation in a notice may expose you to liability under 17 U.S.C. § 512(f). We terminate the accounts of repeat infringers in appropriate circumstances.
18.Communications and consent
By creating an account or placing an order you agree that we may send you transactional communications (order confirmations, shipping notices, service and security notices). You cannot opt out of transactional communications while you have an active account or order.
Marketing email
If you opt in to marketing email, you may unsubscribe at any time using the link in any marketing message or by contacting camilla@alistarchive.com. We process unsubscribe requests promptly and in any event within 10 business days.
Text messages
If you provide your mobile number and consent to text messages, you agree to receive recurring automated marketing and transactional messages at that number. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages.
Calls and recordings
Calls with our client services team may be monitored or recorded for quality and training purposes where permitted by law, and you will be notified at the start of the call.
Electronic records (E-SIGN)
You consent to receive these Terms, policies, disclosures, and notices electronically, and you agree that your electronic acceptance has the same effect as a handwritten signature. You may withdraw this consent by closing your account; withdrawal does not affect the validity of prior electronic records. To receive a paper copy of a disclosure, write to us at the address in the Contact section.
19.Store credit, gift cards, and promotions
- ALIST store credit issued in connection with a return is applied to your account, may be used only on the Services, is not redeemable for cash except where required by law, and expires 12 months after issuance unless a longer period is required by applicable state law.
- Gift cards do not expire and retain their value as required by federal and state law. Gift cards are not redeemable for cash except where state law requires cash redemption of small remaining balances.
- Promotional codes are single-use unless stated otherwise, may not be combined, have no cash value, apply only to eligible items, and may be modified or withdrawn at any time before an order is placed.
- We may reverse a credit, code, or promotional benefit that was obtained in error, through duplicate accounts, or through fraud or abuse.
20.Memberships and subscriptions
If ALIST offers a paid membership or subscription (including any ALIST Club program), the following applies in addition to the membership's own terms: the price, billing frequency, and renewal date are disclosed before you enroll; the membership renews automatically until cancelled; you may cancel at any time through your account or by contacting camilla@alistarchive.com, using the same method by which you enrolled; and cancellation takes effect at the end of the then-current billing period. Where a free or discounted trial is offered, we will disclose the date the trial ends and the amount that will be charged, and we will send a renewal reminder where state law requires one.
21.Third-party services
The Services rely on third parties for commerce, payments, shipping, analytics, and certain product features (for example, virtual fit and try-on tools). Your use of a third-party service may be subject to that provider's own terms and privacy policy. Links to third-party sites are provided for convenience; we do not control and are not responsible for their content, products, or practices.

Where a specific item requires a product-specific warning, that warning is shown on the item's page before purchase.
23.Accessibility
We are working to make the Services usable by everyone. Our commitments, and how to request assistance or report a barrier, are described in the Accessibility Statement.
24.Disclaimers
Except for the Authenticity Guarantee and any warranty that cannot be disclaimed under applicable law, the Services and all items are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that descriptions, measurements, or images are complete or free of error.
Some states do not allow the exclusion of implied warranties, so parts of the exclusion above may not apply to you. Nothing in these Terms limits any non-waivable right you have under the consumer protection laws of your state.
25.Limitation of liability
To the fullest extent permitted by law, neither ALIST nor its officers, directors, employees, agents, or suppliers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising out of or relating to the Services or any item, whether based in contract, tort, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims relating to the Services or to any item will not exceed the greater of (a) the total amount you paid to ALIST for the item or items giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
These limitations do not apply to liability for fraud, for gross negligence or willful misconduct, for personal injury caused by our negligence, or to any liability that cannot be limited under applicable law. Some states do not allow certain limitations, so parts of this section may not apply to you.
26.Indemnification
You agree to indemnify and hold harmless Alist Archive LLC and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your User Content, your breach of these Terms or of any law, your infringement of a third party's rights, or your misuse of the Services. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.
27.Suspension and termination
You may stop using the Services at any time and may request account closure by contacting us. We may suspend or terminate your access, with notice where practicable, if you breach these Terms, if we are required to do so by law, or to protect the Services, other users, or our consignors. Sections that by their nature should survive termination — including User Content licenses, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law — survive.
28.Dispute resolution, arbitration, and class action waiver
Informal resolution first
Before starting arbitration or a court proceeding, you and ALIST agree to try to resolve the dispute informally. Send a written Notice of Dispute to camilla@alistarchive.com (or to the mailing address below) describing the dispute, the relief sought, and your account and order details. We will do the same to the address on your account. Both parties agree to negotiate in good faith for 60 days from receipt of the Notice. This informal process is a condition precedent to starting arbitration, and any applicable limitations period is tolled while it is underway.
Agreement to arbitrate
If the dispute is not resolved informally, you and ALIST agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any item — including their formation, interpretation, breach, or termination, and including claims that arose before these Terms took effect — will be resolved by final and binding individual arbitration administered by JAMS under its consumer arbitration rules then in effect. The Federal Arbitration Act governs the interpretation and enforcement of this section.
- The arbitration will be conducted by a single arbitrator. Unless the parties agree otherwise, the hearing will take place in the county where you reside or, at your election, by telephone or videoconference, or on documents only.
- Payment of arbitration fees is governed by the JAMS consumer rules. Where those rules require a consumer to pay a filing fee that exceeds the cost of filing in court, we will pay the difference. We will not seek our attorneys' fees from you unless the arbitrator finds your claim was frivolous or brought for an improper purpose.
- The arbitrator may award any relief a court could award to that individual party, including declaratory or injunctive relief, but only to the extent necessary to provide relief on that party's individual claim.
- The arbitrator's award is final and binding, and judgment on it may be entered in any court of competent jurisdiction.
Class action and jury trial waiver
You and ALIST agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. You and ALIST waive any right to a trial by jury.
If a court decides that applicable law bars enforcement of any part of this class action waiver as to a particular claim for relief, then that claim (and only that claim) will be severed from the arbitration and may be brought in court, while all other claims proceed in arbitration.
Coordinated filings
If 25 or more claimants submit demands for arbitration raising substantially similar claims and are represented by the same or coordinated counsel, the parties agree that the demands will be administered in batches of no more than 50 claimants each, with a single arbitrator appointed per batch, and that the JAMS may charge a single set of filing fees per batch. This provision is intended to reduce cost and delay for both sides and does not waive any claimant's right to individual adjudication.
Exceptions
Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in a court of competent jurisdiction to prevent infringement or misuse of intellectual property.
How to opt out
You may reject this arbitration agreement by sending written notice to camilla@alistarchive.com with the subject line "Arbitration Opt-Out" within 30 days of the date you first accept these Terms. Your notice must include your name, the email address on your account, and a clear statement that you are opting out of arbitration. Opting out has no other effect on your relationship with ALIST, and we will not retaliate for an opt-out. If you opt out, the Governing law and venue section governs where disputes are heard.
Limitations period
Except where a longer period is required by applicable law, any claim relating to the Services or to an item must be filed within 12 months after the claim arose, or it is permanently barred.
29.Governing law and venue
These Terms and any dispute arising from them are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the Dispute Resolution section. Where arbitration does not apply, you and ALIST consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware. Nothing in this section deprives you of the protection of any mandatory consumer-protection provision of the law of the state in which you reside.
30.Export controls and sanctions
You represent that you are not located in, and are not a national or resident of, any country or region subject to comprehensive U.S. sanctions, and that you do not appear on any U.S. government restricted-party list. You agree not to export or re-export any item purchased through the Services in violation of U.S. export control or sanctions laws, including regulations administered by the Office of Foreign Assets Control.
31.General terms
- Entire agreement. These Terms, together with the documents incorporated by reference, are the entire agreement between you and us about the Services and supersede any prior agreement on the same subject.
- Severability. If a provision is held unenforceable, it is modified to the minimum extent necessary or severed, and the remaining provisions stay in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, labor disputes, carrier failures, and government action.
- No third-party beneficiaries. These Terms do not create rights in anyone other than you and us.
- Headings. Headings are for reference only and do not affect interpretation.
- Notices. We may give notice by email to the address on your account or by posting on the Services. You must send legal notices to the address in the Contact section.
